Respondents Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the respondents to survey the land comprised in survey Nos.269/9A, 269/8A, 262/1A total to an extent of 1.22 1⁄4 acres in Avadathur Village, Jalagandapuram, Mettur Taluk, Salem District with the help of competent surveyor in field measurements and village map and with sufficient police protection and further directing the respondents to mark the land laying corner stones and file a report within a stipulated period thereby directing the respondents to dispose of the petitioner representation dated 17.03.2020 within a fixed time frame.

ORDER

(1)This writ petition has been filed for the issue of a writ of mandamus directing the respondents to act upon the representation made by the petitioner on 17.03.2020 and to conduct a survey and to lay the boundary stones within the time fixed by this Court.

(2)The case of the petitioner is that she is the owner of the subject property and the revenue records also stands in her name. The petitioner wanted the respondents to survey her property and to fix boundary stones and the petitioner has also paid the necessary charges. Since the representation / application given by the petitioner was not considered, the present writ petition has been filed seeking for appropriate directions.

(3)Heard the learned counsel for the petitioner and Mr.E.Balamurugan, learned Special Government Pleader accepting notice on behalf of the respondents.

(4)Taking into consideration, the facts and circumstances of the case and the limited relief sought for in this writ petition, there shall be a direction to the 2nd respondent to consider the representation/application made by the petitioner on 17.03.2020 and act upon it strictly in accordance with law and take a decision with regard to the survey of the subject property within a period of four weeks from the date of receipt of a copy of this order. The petitioner is directed to make a fresh representation to the 2nd respondent along with all the relevant documents and also a copy of the representation / application dated 17.03.2020 and also a copy of this order. (5)This writ petition is disposed of with the above direction. No costs.
