O R D E R

(The case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 147, 148, 341, 394, 324, 307, 506(ii) of IPC in Crime No.1060 of 2009 on the file of the respondent police in P.R.C.No.254 of 2010 on the file of the V Metropolitan Magistrate, Egmore, seeks anticipatory bail.

2. Today, when the matter was taken up for hearing, the learned Additional Public Prosecutor submitted that earlier, the petitioner had filed a petition to recall the warrant in Crl. M.P.No. 1697 of 2020 before the learned V Metropolitan Magistrate, Egmore, Chennai and the same was dismissed on 13.08.2020. He would further submit that the petitioner has to challenge the order of dismissal of the recall petition. Hence, he prays to close the anticipatory bail petition.

3. In view of submission made by the learned Additional Public Prosecutor, the petitioner is directed to surrender and file an application for recalling the warrant and the learned Judge shall take it on file and pass orders on the merits of the case on the same day of surrender.
