ORDER

The petitioner, who was arrested and remanded to judicial custody on 13.02.2026 for the alleged offence under Sections 142, 148, 302 of IPC in Crime No.236 of 2023 on the file of the respondent police, seeks bail. 1/4

2. According to the prosecution, the petitioner along with other accused persons, joined together to commit the murder of the de-facto complainant's husband. Hence, the present case has been registered.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and that he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner has been in judicial custody since 13.02.2026 and he is ready to co-operate with the investigation and abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the petitioner.

Per contra, the learned Government Advocate (Criminal Side) appearing for the respondent Police reiterated the prosecution and submitted that this a case of the year 2003; NBW was ordered on 03.01.2026, whereas the petitioner was able to be secured only on 13.02.2026 and that now the case is posted for examining of L.W.1. He further submitted that the petitioner has three previous cases. Hence, he opposed the grant of bail to the petitioner.

5. Considering the totality of the circumstances of the case and on the fact that the petitioner has three previous cases, this Court is of the view that, it is not an appropriate time to consider this bail application. 2/4
