The learned counsel for the petitioner submitted that the H.M.O.P.No.67 of 2008 was dismissed for default. The learned counsel, therefore seeks liberty to withdraw this Transfer Civil Miscellaneous Petition without prejudice to his right to file a fresh petition to transfer the proceedings.
In view of the endorsement made by the learned counsel for the petitioner, the Transfer Civil Miscellaneous Petition is dismissed as withdrawn with liberty. No costs. Consequently, connected Miscellaneous Petition is closed.
