This Writ Petition has been filed to direct the respondents to issue subdivision patta in favour of the petitioner for the property morefully disclosed in the prayer to this Writ Petition, based on the petitioner's representation dated 28.12.2023, within a time frame to be fixed by this Court.
2.The petitioner has filed supporting documents along with this Writ Petition, in support of the petitioner's representation dated 28.12.2023. This Court is not expressing any opinion on the merits of the petitioner's representation. At the outset, the learned Government Advocate, appearing for the respondent would submit that the representation given by the petitioner being an old one, the petitioner will have to submit a fresh representation. 3.Learned counsel for the petitioner, on instructions, would submit that the petitioner is willing to submit a fresh representation. 4.
No prejudice would be caused to the respondent if the petitioner's representation seeking for issuance of sub-division patta in the name of the petitioner for the property morefully disclosed in the prayer to this Writ Petition is considered on merits and in accordance with law, after giving due consideration to the supporting documents produced by the petitioner and after hearing all the necessary parties, within a time frame to be fixed by this Court. This Court is not expressing any opinion on the merits of the petitioner's representation.
5.For the foregoing reasons, this Writ Petition is disposed of by directing the petitioner to submit a fresh representation seeking for issuance of subdivision patta in the name of the petitioner for the property morefully disclosed
in the prayer to this Writ Petition along with supporting documents, within a period of two weeks from the date of receipt of a copy of this order. On receipt of the said representation, along with supporting documents, the respondent shall pass final orders on merits and in accordance with law on the petitioner's request for issuance of sub-division of patta in his name, after giving due consideration to the supporting documents produced by the petitioner and after hearing the objections of all the necessary parties, within a period of twelve weeks thereafter.
