ORDER

This Criminal Original Petition has been filed seeking a direction to the respondent Police no to harass the petitioner under the guise of enquiry for the purpose of settling a monetary dispute.

2. The case of the petitioner is that he is the owner of the property and had entrusted the construction work to one Arun Prasad, an independent Contractor. A person employed under the said Contractor, namely,

Ramachandran, was electrocuted and died. According to the petitioner, it is the responsibility of the Contractor to pay compensation to the family of the deceased worker. In fact the petitioner already paid Rs.1,00,000/-, however, an additional sum of Rs.3,50,000/- is being demanded. In this regard, the respondent Police have called upon the petitioner to appear for enquiry.

3. The learned counsel for the petitioner, on instructions, submitted that the petitioner will appear before the respondent Police on 27.04.2026.

4. Considering the facts and circumstances of the case, this Court directs the petitioner to appear before the respondent Police on 27.04.2026, along with necessary documents, to establish that the work was entrusted to an independent Contractor and that the petitioner has no direct employer-employee relationship with the deceased. On such appearance, the respondent Police shall enquire the petitioner and proceed in accordance with law.
