ORDER
The writ petition has been filed seeking a direction to the respondents to
permit the petitioner to vacate and handover the staff quarters at B-1, First Floor, Goundampalayam, TNHB Quarters, Coimbatore- 641030 without insisting for payment of penal charges which amounts to Rs.8,44,620 /-
2. It is the case of the petitioner that he was working as Assistant in Regional Centre of Tamil Nadu State Judicial Academy, Coimbatore. The petitioner was allotted with staff quarters bearing Flat No.B1, First Floor, TNHB Quarters, Goundampalayam, Coimbatore. The petitioner's family and the petitioner were residing in the said flat. In the meanwhile, the petitioner was transferred by way of deputation to the Principal Seat of High Court, Madras on 10.06.2022 and joined the duty at High Court Madras. Thereafter, the petitioner was posted on OD to Tamil Nadu Judicial Academy Regional Centre, Coimbatore on 28.11.2022 till 24.03.2023. Likewise, the petitioner rejoined duty at Madras High Court and thereafter, he was posted on OD to Tamil Nadu Judicial Academy Regional Centre, Coimbatore from 02.05.2023 till 30.04.2024.
As on today, the petitioner is working as an Assistant in Tamil Nadu State Judicial Academy Headquarters, Chennai on deputation. Every month rent is being deducted from the petitioner's salary by the office and the same is remitted with the Housing Board without any default. Even the maintenance charges of 4% is also been deducted without any arrears.
informed that there is no arrears towards rent, maintenance and electricity charges also. The second respondent informed the petitioner that he have to pay a sum of Rs.8,44,620/- towards penal charges (June 200 till March 2026). Therefore, the petitioner made a detailed representation to the second respondent dated 13.03.2026 and 25.03.2026 to permit the petitioner to vacate and handover the staff quarters, coimbatore without insisting payment of penal charges which amounts to Rs.8,44,620/- and the same is not considered. Hence, the present writ petition.
3. The learned counsel for the petitioner submitted that he is ready to vacate the premises within a period of four weeks from the date of receitp of a copy of this order. This Court may direct the respondents to permit the petitioner to vacate the premises without insisting any payment of penal charges.
4. The learned Standing Counsel appearing for the respondents fairly submitted that this Court may direct the petitioner to vacate the quarters within the reasonable time as fixed by this Court. Till such time, no penal charges will be claimed from the petitioner.
5. Considering the facts and circumstances of the case and also the submission made by the learned Standing Counsel, this Court, without
expressing any opinion on the merits of the case, directs the petitioner to vacate the quarters and hand over the same to the respondents within a period of four weeks from the date of receipt of a copy of this order; The respondents shall accept the possession of the quarters without demanding any penal charges from the petitioner.
