PRAYER :

Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the 2nd respondent to register the settlement deed dated 17.05.2022. The 2nd respondent by his refusal RFL/2 Joint Sub-Registrar Dharmapuri/50/2022 dated 17.05.2022 to register the sale deed and return the same to the petitioner.

ORDER

The Settlement Deed executed by the petitioner on 17.05.2022 has been returned by the 2nd respondent herein, seeking for enclosure of the parent title deeds.

2.According to the petitioner, he has lost the title deeds and for that purpose he has given a complaint to the 3rd respondent, which is pending.

3.This Court is of the view that the complaint before the 3rd respondent would play a crucial role for the purpose of https://hcservices.ecourts.gov.in/hcservices/

taking a final decision in the petitioner's request for the registration of the Settlement Deed.

4.In this respect, a direction is given to the 3rd respondent herein to inquire into the petitioner's complaint dated 13.04.2022 and complete the same within a period of three

(3) months from the date of receipt of a copy of this order. On such compliance, the petitioner is at liberty to make a representation to the 2nd respondent herein by ventilating his grievances, who in turn shall consider it as expeditiously as possible.

5.With the above direction, the Writ Petition stands disposed of accordingly. No costs.
