CMP Nos.9779, 9782 and 9783 of 2020 CMP Nos.9779, 9782 and 9783 of 2020 in A.S.No.175 of 2013 S.KANNAMMAL, J., These applications have been filed seeking to condone the delay of 410 days in seeking to set aside the abatement caused by the death of the 1st appellant, to set aside abatement and to bring on record the petitioners 3 to 6 as the legal representatives of the deceased 1st appellant.
2. The learned counsel for the respondents has no objection for these petitions being allowed.
3. Considering the reasons assigned in the affidavit filed in support of the petitions, the delay of 410 days in filing the petition seeking to set aside abatement is condoned, the abatement caused by the death of the 1st appellant is set aside and the petitioners 3 to 6 are brought on record as appellants 3 to 6 in the appeal.
4. The Registry is directed to carryout amendment and post the appeal for final hearing on 18.03.2012.
5. It is submitted by the learned counsel for the respondents that the 2nd respondent died on 01.12.2021 and he has already filed memo to that effect. Therefore, the appellant shall take steps to bring on record the legal heirs of the 2nd respondent.
