O R D E R
The petitioner herein involved in a construction business had dispute with rival construction company. Therefore, the complaint been given and registered under C.S.R.No.68 of 2024.
2. When the petitioner was called for an enquiry vide summon dated 07.03.2024 to appear on 12.03.2024, the petitioner has failed to participate in the enquiry.
3. The learned Government Advocate (Crl.Side) appearing for the respondent police states that if the petitioner participate in the enquiry and give his explanation, the same will be considered and the complaint will be proceeded based on the informations collected during the enquiry.
4. Per Contra, the learned counsel for the petitioner submits that immediately on receipt of the summon dated 14.03.2024 promising to appear again on 22.03.2024, he also showed the copy of the letter. 2/4

The said letter clearly indicates that the petitioner has not truly co-operated for the investigation, but had appeared before the respondent police two days after the day on which they supposed to appear, even on that day they have not produced any documents, but took time to appear on the later day instead of appearing on the day on which they promise, they have approached this Court alleging that the respondent police is harassing them.
6. This Court finds that it is under the garb of alleging police harassing the petitioner wants to avoid participating in the enquiry process. The court cannot be a privy to such dubious attempt of suspect. Hence, this Criminal Original Petition is dismissed. 29.04.2024 Vv To
