ORDER

The above writ petition has been filed seeking for a direction to the 2nd respondent to take charge of all the funds and accounts of the 3rd respondent, and direct the 2nd respondent to strike off the name of the 3rd respondent from its registers.

2.The South Indian Film Casting Directors and Celebrity Managers Association / 3rd respondent was formed with a group of people who are working as casting directors in the motion picture industry. When the members of this Association were increased, unfaithful members joined the association as a crew to take over the association. Once the membership grew, disloyal members joined together to gain majority and took over the control of the association. The books and accounts were not maintained properly, there were malpractices in the funds collected from the members. They have also started to implement unlawful plans. The association's property has been taken away by the administrators, 2/4

and the office has been kept vacant for the past two years. All the activities were against the Tamil Nadu Societies Act, 1974. Therefore, the petitioner has made a complaint to the 2nd respondent seeking for an appropriate action, and for a direction to the 2nd respondent to consider the representation of the petitioner dated 14.03.2023. 3.The learned Government Advocate, however, submitted that the petitioner has sought for two prayers, one is to take charge of all the funds and accounts of the 3rd respondent, which is impermissible as there is no provision available for taking over the charge of the 3rd respondent association. The second relief sought by him was to strike off the name of the 3rd respondent from its registers, when the 3rd respondent association fails to furnish the accounts for three consecutive years, then only the striking off name would come. In the present case, the 3rd respondent association has filed its accounts for 2020 which has been accepted and 2021 is pending for consideration. Hence the prayers M.DHANDAPANI, J.

dismissal of the same.

4.In view of the above, this petition stands dismissed. However, liberty is granted to the petitioner to approach the Civil Court for appropriate remedy. No costs.
