Heard Mr.Vijayan, learned Senior Counsel, representing for Mr.Nithyananda, learned counsel for the petitioner and Mr.P.Ramanlaal, learned Additional Advocate General, Assisted by Mr.Yogesh Kannadasan, learned Special Government Pleader for the respondents. 2.Challenging the impugned proceedings in Proc.No.2183/A1/ 2022 dated 27.04.2022 issued by the second respondent, the writ petition has been filed.

3.When this Court had earlier passed orders in W.P. No.5977 of 2019 dated 08.12.2021 directing the petitioner herein, who was arrayed as the sixth respondent to comply with the earlier orders of the Hon'ble Division Bench in W.A. No.1538 of 2014 dated 23.04.2015 for the 2/6

purpose of receiving, admitting, registering and releasing the documents connected with S.No.91, situated at Nerkundram Village, Maduravoyal Taluk, Thiruvallur District in favour of the petitioners in that writ petition, the petitioner had complied with the same. The petitioner has now been placed under suspension through the impugned order dated 27.04.2022.

4.Learned Senior Counsel for the petitioner submitted that grave charges, which are contemplated as stipulated in the impugned order, relate to registration, done by the petitioner, pursuant to the orders of this Court, passed in W.P. No.5977 of 2019.

5.Such a submission is spelt in the counter affidavit filed by the second respondent themselves. They have admitted that owing to the registration, carried out by the petitioner to the Document No.2970 of 2022, the petitioner was placed under suspension through the impugned order.

6.I am unable to comprehend as to how the compliance of orders of this Court would amount to misconduct for which departmental action has been initiated against the petitioner herein. Apparently, the very purpose for which the petitioner has been placed under suspension, suffers from grave illegality.

7.As a matter of fact, the earlier order passed by this Court in W.P. No.5977 of 2019 was also a direction to the petitioner herein to comply with the orders of the Division Bench in W.A. No.1538 of 2014 dated 23.04.2015.

8.In the light of the above findings, the impugned Proceedings dated 27.04.2022 issued by the second respondent is quashed and the writ petition stands allowed. Consequently, connected W.M.P. stands closed. No costs.
