Respondent Prayer:- Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus directing the respondent to revoke the order of suspension dated 31.12.2020 made in S.O.No.26/2019/E1 by considering the petitioner's representation dated 24.03.2020 in the light of the judgment of the Hon'ble Supreme Court in Ajay Kumar Choudhary Vs. ORDER

By consent, the writ petition is taken up for final disposal and is disposed of by this order.

Mr.C.Kathiravan, learned Government Advocate accepts notice on behalf of the respondent.

The petitioner has filed the present writ petition seeking for issuance of a writ of mandamus, directing the respondent to consider his representation dated 24.03.2020 seeking revocation of the order of suspension and reinstatement in the light of the Apex Court judgment dated 16.02.2015 made in SLP [C] No.31761/2015 [Ajay Kumar https://hcservices.ecourts.gov.in/hcservices/
Choudhary V. Union of India].

Learned counsel for the petitioner would submit that the petitioner will be satisfied if a direction is issued to the respondent to consider and pass orders on the petitioner's representation dated 24.03.2020 on merits within a stipulated time frame.

This Court heard the submissions of the learned Government Advocate appearing for the respondent and perused the materials placed before it.

Though the petitioner has prayed for a larger relief, this Court, in the light of the facts and circumstances of the case and without going into the merits of the claim made by the petitioner, directs the respondent to consider and dispose of the petitioner's representation dated 24.03.2020 on merits and in accordance with law and pass appropriate orders within a period of six weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner herein.

The writ petition stands disposed of accordingly. No costs.
