ORDER

This petition has been filed seeking to set aside the order passed in Crl.M.P.No.89 of 2025 dated 14.03.2025 on the file of the learned Special Judge under the Tamil Nadu Protection of Interest of Depositors (in financial establishment) Act, 1997, and relaxing the bail condition passed in Crl.M.P.No.2050 of 2024 dated 27.08.2024, directing the petitioners/A2 to A4 to appear before the Lower Court on the first working day of once in 2 months from September 2024 until further orders.

2. Learned counsel for the petitioners submitted that now the investigation is almost completed and the charge sheet has also been filed before the Special Court under TNPID Act, Chennai. The appearance of the petitioners before the Trial Court police is on the first working day of once in 2 months from September 2024, and they will be permitted upon receipt of summons. He further submits that the 2nd petitioner/A3, aged about 69 years, and has health ailments and is unable to walk without support. Further, all the petitioners are women.

3. Learned Government Advocate (Crl.Side) for the respondent submits 2/4

that the investigation is completed and a charge sheet has been filed. The petitioners have approached before this Court for total relaxation, and they have only been asked to appear once in two months.

4. Considering the facts and circumstances of the case, it is seen that the petitioners are women, and they all have residences in Chennai city and live with their respective families.

5. In view of the above, this Court finds that the conditions imposed on the petitioners may not be required. The petitioners are directed to appear before the Trial Court as and when on receipt of summons.

6. With the above observations and direction, this criminal original petition is ordered.
