Respondent This petition is filed under Section 24 of C.P.C. to withdraw and transfer the suit in O.S.No.307 of 2008 pending on the file of the District Munsif Court at Tambaram, Kancheepuram District to try along with the suit in O.S.No.500 of 2009 pending on the file of Sub-Court at Tambaram, Kancheepuram District.

ORDER

The petitioner is the plaintiff in O.S.No.307 of 2008 on the file of the District Munsif Tambaram, Kancheepuram District, has come before this Court seeking transfer of the above suit to the file of Sub Court, Tambaram, where O.S.No.500 of 2009 filed by the respondent is pending.

The respondent counsel has got no objection for transferring the suit O.S.No.307 of 2008 filed by the petitioner pending before the District Munsif, Tambaram, Kancheepuram to the file of Sub Court, Tambaram, Kancheepuram District where O.S.No.500 of 2009 is pending. 3.

The petition is allowed. The Sub Court, Tambaram, Kancheepuram District is directed to conduct joint trial and to dispose of the same by a common judgement. Both the parties shall cooperate for the disposal of the case and the Trial Court shall dispose the suits at the earliest. No costs. Consequently the connected M.P.No.1 of 2015 is closed.
