The sole petitioner died during the currency of the Transfer Civil Miscellaneous Petition. The petitioner's legal heirs are yet to file a petition before the Trial Court to implead them as parties. The respondents have already filed a petition to implead the legal representatives of the sole defendant in O.S.No.127 of 2009 on the file of the III Additional District Court, Cuddalore at Virudhachalam.
2. Since the petitioner is no more, the Transfer Miscellaneous Petition is dismissed as abated. This order would not stand in the way of the legal representatives of the sole petitioner to file a Transfer Civil Miscellaneous Petition if they are impleaded in O.S.No.127 of 2009 on the file of III Additional District Court, Cuddalore at Virudhachalam.
