Respondents Prayer: This Writ petition has been filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarifried Mandamus calling for the records in respect of letter No.Rc.No.0484/D/08 dated 19/08/2008 issued by the second respondent to the petitioner to quash the same and to direct the first and second respondent to evaluate the tender submitted by the petitioner in the Re-Tender DIPR/3664/TENDER/2008 vide Advertisement in the "Daily Thanthi" dated 06/08/2008 as per the Tamil Nadu Transparency in Tenders Act, 1998 and rule 33 of Tamil Nadu Transparency in Tenders rules 2000 and award the same to the petitioner.

ORDER

The petitioner prays to issue a Writ of Certiorarifried Mandamus calling for the records in respect of letter No.Rc.No.0484/D/08 dated 19/08/2008 issued by the second respondent to the petitioner to quash the same and to direct the first and second respondent to evaluate the tender submitted by the petitioner in the Re-Tender DIPR/3664/TENDER/2008 vide Advertisement in the "Daily Thanthi" dated 06/08/2008 as per the Tamil Nadu Transparency in Tenders Act, 1998 and rule 33 of Tamil Nadu Transparency in Tenders rules 2000 and award the same to the petitioner.

When the matter is listed today, the learned counsel for the petitioner made a submission that the matter has become infructuous and he has also made an endorsement to the effect: "The prayer related to challenging a tender notice of the year 2008 and by virtue of lapse of time, nothing survives in the matter and may be treated as having become infructuous." 3.In view of the above statement and endorsement made by the learned counsel for the petitioner, this Writ Petition is dismissed as having become infructuous.
