R.Raja v. V.Gunavathi
O.P..No.410 of 2016 O.P.No.410 of 2016 N.SATHISH KUMAR, J.
This application has been filed challenging the interim order passed by the Sole Arbitrator, wherein, he has rejected the application seeking for attachment of property which was the subject matter of the agreement between the parties.
2. On perusal of the order passed by the learned arbitrator, it is seen that the arbitrator, after perusing the entire materials on record with regard to the dispute between the parties, sent a notice to the respondent through a person named Thiru.Senthilkumar, but since the respondent's house was locked, notice could not be served to him and the arbitrator declined to pass any order of attachment stating that he could not pass any order in this matter without hearing the respondent. Aggrieved by the same, the present Original Petition has been filed by the applicant.
3. In view of the order passed by the learned arbitrator, this Court does not find any reason to interfere with the same and none of the grounds have been raised by the applicant to challenge the same. Further, the learned counsel for the applicant has not adhered to any of the terms as contemplated under Section 34 of the Act to interfere with the order of the learned arbitrator and accordingly, this application is dismissed. No costs. 22.09.2020 http://www.judis.nic.in
