CMP.No.10010 of 2021 in CMA.SR.No.55983 of 2021 R.SUBRAMANIAN, J Despite service of notice, the respondent is not appearing either in person or through counsel duly instructed.

2.Though the delay is enormous, the petitioner seeks to explain the same stating that the injury suffered by him in the accident had restricted his movements, apart from causing mental stress. It is also stated that he could pay the Court fee for the appeal only after the compensation was realized through execution.

3.Considering the nature of injuries suffered by the petitioner, I am of the opinion that the delay deserves to be condoned. However, it is made clear that the petitioner will not be entitled to interest for the delay period for the enhanced compensation, if any granted by this Court in this appeal.
