ORDER

This petition is filed seeking direction to the learned Judicial Magistrate at Harur, to permit the Petitioner/Complainant to withdraw the amount of Rs.2,00,000/- deposited by the Respondent/Accused before the trial Court in S.T.C.No.245 of 2013.

2. The learned counsel for the petitioner seeks permission to withdraw this petition and he also made an endorsement to that effect.

3. In view of the above submission and the endorsement made, this petition is dismissed as withdrawn. It is made clear that the respondent has already served the entire period of sentence as imposed by the Trial Court and confirmed up to this Court. Therefore, the respondent is entitled to withdraw the amount, which was already deposited by him at the time of suspending the sentence by this Court, and lying before the Trial Court. The respondent is directed to file appropriate application before the Trial Court and on receipt of the same, the Trial Court is directed to permit the respondent to withdraw the amount, which was already deposited by him, without ordering notice to the complainant.
