Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus to call for the entire records of the second respondent pertaining to his proceedings No.19438/EDS-1/2007 dated 11.09.2007 designating the fifth respondent as Junior Engineer (Industries) for inclusion of his name in the panel for the year 2004 - 2005 for promotion to the post of Assistant Director (Technical) and the Memo dated 30.05.2016 in R.C.No.9675/EE2/2016 of the third respondent rejecting petitioner's request for revision of seniority in G.O.(4D) No.9 Micro Small and Medium Enterprises (E1.1) Department dated 23.02.2010 and quashing the same and consequently directing the respondents 1 to 3 to revise the seniority list in the post of Assistant Director (Technical) vide G.O. (4D) No.
9, (Micro Small and Medium Enterprises (E1.1) ) Department dated 23.02.10 by assigning the petitioner Seniority No.62 instead of No.74 in G.O.(4D) No.9 MSME (E1-(1)) Department dated 23.02.2010 and Seniority No.25 instead of Seniority No.36, in the post of Deputy Director (Technical) in G.O.(2D) No.17 MSME (E1-(1)) Department dated 08.08.2017 and provide him all consequential service benefits.

Today when the matter was taken up for hearing, the learned counsel for the petitioner submits that aggrieved by the action of the respondents for rejecting the claim of the petitioner, the petitioner had approached this Court by way of filing the writ petition vide W.P.No.5950 of 2021. As such, there is no need to proceed with the present writ petition.
2.In view of the aforesaid submission and preserving all the rights of the petitioner in the said writ petition, the present writ petition is closed. No costs. Consequently connected miscellaneous petitions are closed.
