C.M.P.No.9377 of 2020 in S.A.No.944 of 2009 Dr.G.JAYACHANDRAN, J.

This petition is filed to implead the 2nd petitioner/proposed party as 2nd appellant in pending second appeal No.944 of 2009.

2.The 2nd petitioner has purchased the property from the appellant on 30.08.2012. If the appellant has lost the case and alienated the property to the 3rd party pending second appeal, the Court need not hear the purchaser pendente lite merely because subsequent purchase apprehends that the appellant will not pursue the matter. More particularly, when the counsel for the appellant as well as the pendente lite purchaser are one and the same and the matter is pending on board for more than 11 years.

3.The suit is of the year 2006. This Court feels that it is only a dilatory tactics to delay in disposing of pending disposal. Hence, this petition is dismissed. No costs.
