This Petition has been filed to condone the delay of 111 days in filing the petition to set aside the abatement caused due to the death of K.Shantha Kumar in the A.S.No.289 of 2008.

2. Heard the learned counsel for the petitioners and the learned counsel for the respondents.

3. On being satisfied with the averments stated in the affidavit filed in support of the petition and the submissions made by the learned counsels on both sides, the delay of 111 days in filing Appeal Suit No.289 of 2008 is condoned.
