Prayer: Writ Petition is filed under Article 226 of the Constitution of India seeking for an issuance of writ of mandamus, (i) directing the 2nd Respondent to forward the failure report submitted by the 3rd Respondent in Na.Ka.No. Pa.2/39401/2018, dated 19.11.
2019 to the 1st Respondent within a specified time, the 1st Respondent to refer the said dispute for adjudication to the Industrial Tribunal and initiate criminal action against the 4th and 5th Respondents and their officials for having committed the offences under Sections 31(1) and 31(2) by violating sections 33 (1) (a) and Section 9A of the ID Act either in their own or by authorizing the Petitioner union or any other official from their department to file a complaint before the concerned Metropolitan Magistrate Court, Chennai under Section 34 (1) of the ID Act based on the petitioner complaint dated 27.05.2022 and the 4th and 5th Respondents to maintain status quo as on the date of commencement of conciliation proceeding in the dispute in Na.Ka.No.Pa.
2/39401/2018 and not to alter the conditions of service of the Date Entry operators who are working in the E-Service Centres / Common Service Centres of the 4th Respondent corporation adverse to them in any manner, award costs; (ii) directing the 3rd respondent to initiate and commence the conciliation proceeding on the 2(k) dispute raised by the petitioner Union before the 3rd respondent on 24.05.2022 and conclude the same within a specified time so as to bring an amicable settlement and to submit a failure report to the 1st respondent, the 1st respondent to refer the dispute to the Industrial Tribunal for adjudication, within a specified time and the 4th and 5th respondents not to alter the conditions of service of the Date Entry Operators adversely in any manner till the dispute raised by the petitioner Union dated 24.05.
2022 is either settled or adjudicated in accordance with law, award costs.

ORDER
When the matter came up for hearing, it can be seen that the failure report has been forwarded and even the official respondent has refused the referral and as such, the prayer made in this writ petition has become infructuous.
2. Accordingly, the writ petition is dismissed as having become infructuous. No costs. Consequently, connected miscellaneous petition is also closed.
