ORDER

This Criminal Original Petition has been filed seeking a direction to the the 2nd respondent police not to harass the petitioner under the guise of enquiry.

2. The case of the prosecution is that, a complaint preferred by one Esther Rani against the petitioners was registered as CSR No.0233 of 2026 dated 27.03.2026 at the K-10 Koyambedu Police Station. The allegation involves the incidental filming of the complainant while she was vending flowers and the subsequent posting of the said video on YouTube. Hence, the case has been registered.

3. The learned counsel for the petitioners submitted that the video was captured casually as part of a general atmosphere recording. There was absolutely no malicious intention to circulate the footage in a derogatory manner. Further, he submitted that the 1st petitioner has already appeared before the 2nd respondent police on 27.03.2026 and submitted an undertaking affirming full cooperation, and also committed to producing necessary identification including his Aadhar card to conclude the enquiry. However, despite the trivial nature of the incident and the petitioners' continued cooperation, the 2nd

respondent is reportedly "dragging" the enquiry process unnecessarily. 4.

Learned Government Advocate (Criminal Side), on instructions, submitted that based on the complaint given by the Esther Rani, the case was registered as CSR No.233 of 2026 and is pending on the file of the respondent Police, and that the petitioner was called only for enquiry.

5. Heard both sides and perused the materials available on record.

6. In such circumstances, this Court directs the respondent police to issue notice for enquiry mentioning the date as 27.04.2026. On receipt of such notice, the petitioner shall appear before the respondent police on the said date for enquiry and co-operate with the investigation. It is made clear that the petitioner shall not be harassed during the course of enquiry. If any cognizable offence is made out, the respondent Police shall register a First Information Report and proceed in accordance with law.

7. At this juncture, the learned counsel for the petitioner submitted that the videos posted on the YouTube have been deleted and undertakes to produce the proof before the respondent police.
