Petition has been filed under Section 24 of C.P.C., to withdraw the H.M.O.P.No.6 of 2015 pending on the file of the Sub Court, Tiruchengodu and transfer the same to the file of the Sub Court, Harur.

O R D E R

The wife, who is the respondent in H.M.O.P.No.6 of 2015, has come forward with this petition to transfer the same from the file of the Sub Court, Tiruchengodu, to the file of the Sub Court, Harur.

2.Learned counsel for the petitioner/wife submitted that the respondent/husband has filed a petition in H.M.O.P.No.6 of 2015 on the file of the Sub Court, Tiruchengodu, for divorce. Since her parents are aged persons, she has no other source to take care of her parents and therefore, it is difficult for her to travel from Saamiyapuram to attend the Court at Tiruchengodu. Hence, she prays that H.M.O.P.No.6 of 2015 may be transferred from the file of the Sub Court, Tiruchengodu to the file of the Sub Court, Harur.

3.Though the respondent has been served with notice, no one represented the respondent today.

4.Considering the arguments advanced by the learned counsel for the petitioner and the averment in the affidavit, the petition in H.M.O.P.No.6 of 2015 is ordered to be withdrawn from https://hcservices.ecourts.gov.in/hcservices/

the file of the Sub Court, Tiruchengodu and transferred to the file of the Sub Court, Harur for disposal in accordance with law. The Presiding Officer, Sub Court, Tiruchengodu is directed to transmit all the records pertaining to H.M.O.P.No.6 of 2015 to the file of Sub Court, Harur, within a period of fifteen days from the date of receipt of a copy of this order. 5.Accordingly, this Transfer Civil Miscellaneous petition is ordered. No costs. Consequently, connected Miscellaneous Petition is closed.
