Prayer: This petition has been filed Under Section 24 of the Code of Civil Procedure code to withdraw the H.M.O.P.No.60 of 2009 from the file of Principal Subordinate Court, Kumbakonam and to transfer the same on the file of the Sub Court, Chidambaram. ORDER

This petition has been filed by the petitioner/wife seeking transfer of O.P.No.60 of 2009 filed by the respondent/husband before the Principal Subordinate Court, Kumbakonam, for divorce to the file of Sub Court, Chidambaram.

2.Both the parties appeared before this Court and it is seen that there is no possibility for settlement. The respondent is also disabled person and he met with an accident. Therefore, in the interest of both parties, it is appropriate to transfer the O.P.No.60 of 2009 pending on the file of Sub Court, Kumbakonam to the file of Principal Sub Court, Myladudurai. Similarly, since the matter is pending from the year 2009, the Principal Sub Court, Kumbakonam is directed to send the bundle to the Principal Sub Court, Myladudurai, within one week from the date of receipt of a copy of this order. On such receipt, the Principal Sub Court, Myladudurai is directed to dispose of the matter within a period of two months from the date of receipt of the bundle.

3. In the result, the Transfer Civil Miscellaneous Petition is disposed of. Consequently, connected Miscellaneous Petition is closed. No costs.
