A.No.2762 of 2025 in C.S.No.25 of 2015 C.V.KARTHIKEYAN, J.

This application has been filed to issue summons for the attendance of Mr.T.T.Suresh who is residing at Kilpauk, Chennai to tender evidence on behalf of the plaintiff.

2. The suit had been filed for recovery of money and for cancellation of sale deed. The plaintiff had examined himself as P.W.1 and he had also been cross-examined. In the affidavit filed in support of this application, it had been contended that the witness who is proposed to be examined had known the second and third defendants and another individual Porselvan and claimed that they are close friends. It is further contended that his evidence is required to speak about the transaction which had taken place and which is the subject matter of the suit.

3. The learned counsel for the third respondent submitted that the scope of the said witness is very limited and he can only speak about the individuals and not about the transaction.

4. But at any rate, the witnesses could be cross examined on all aspects. Hence, this application is allowed.
