ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 191(2), 191(3), 126(2), 296(b),

109, 125, 351(3) r/w 3(5) of BNS, in Crime No.735 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that due to previous enmity, the petitioner joining hands with other accused waylaid the defacto complainant, and attacked him with knife and other deadly weapons, thereby causing severe injuries. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that this is the third anticipatory bail petition. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, submitted that the petitioner has seven previous cases to his credit, out of which three cases pertain to offences of attempt to murder and three cases relate to dacoity. Hence, he opposed to grant anticipatory bail to the petitioner.

5. I have given my anxious consideration to either side submissions.

6. From the submissions made by the learned Government Advocate (Crl.Side), it is seen that the petitioner has seven previous cases against him. It is amply clear that the petitioner has misused the liberty already granted by this Court, and if the petitioner is enlarged on anticipatory bail, he may be emboldened to commit similar offences in future. Therefore, this Court is not inclined to enlarge the petitioner on anticipatory bail.
