PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents to pay interest amounts to the petitioner for the belatedly paid Service Gratuity, Provident Fund and Leave Salary along with the arrears payable on account of 15th Wage Settlement at the rate of 6% per annum for 8 months of delayed payment in the light of judgment passed by this Court on 23.10.2024 in W.P.No.30766 of 2024 and pass orders.

ORDER
The writ petition has been filed seeking a direction to the respondents to pay the petitioner the interest at the rate of 6% for the delayed payment of his retiral benefits including Service Gratuity, Provident Fund and Leave Salary etc.,

It is the case of the petitioner that he had joined the services of the first respondent-Corporation on 09.06.1989 and had retired from service on 30.06.2024, on attaining the age of superannuation. The petitioner would submit that the respondents ought to settle his retiral benefits on the date of his retirement, however, the same was paid to him only on 11.03.2026, after a delay of 8 months. Besides, the petitioner was not paid the difference in Gratutity amount and Leave salary which he is entitled to, as per revision of pay pursuant to the implementation of 15th Wage Settlement, which would take effect from 01.09.2023. Therefore, the petitioner had submitted a representation on 16.03.2026 to the respondents to pay the difference in Leave Salary, difference in Gratuity and Provident Fund and Pension arrears along 2/4
with interest, but the same was not considered to date. Hence, the petitioner is before this Court, to espouse the said cause. 3.Heard the learned counsel on either side and perused the materials available on records.

Taking into consideration the facts and circumstances of the case and the materials available on record, this writ petition is disposed of with a direction to the respondent Corporation to pay the eligible amount as payable to the petitioner along with interest at the rate of 6% per annum for the delay period in settling the retiral benefits along with arrears payable as per 15th Wage Settlement, within a period of six weeks from the date of receipt of a copy of this order.
