M.Noorul Ayin v. C.D.J.Sankar
IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED : 23.04.2015 CORAM :
THE HONOURABLE MR. JUSTICE N.KIRUBAKARAN Tr.CMP No.314 of 2015 and M.P.No.1 of 2015 M.Noorul Ayin .. Petitioner/Defendant vs.
C.D.J.Sankar .. Respondent/Plaintiff. Prayer :- Transfer Civil Miscellaneous Petition filed under Section 24 of C.P.C. to withdraw the O.S. unnumbered of 2015 on the file of Sub Court, Panruti and to pass an order to transferr the same to the file of Sub Court, Nagapattinam.
For Petitioner : Mr.M.Thamizhavel
JUDGMENT
The petitioner who is likely to face the unnumbered suit filed by the respondent for recovery of money for the supply of goods has come before this Court seeking transfer of the O.S. unnumbered of 2015 on the file of Sub Court, Panruti to Sub Court, Nagapattinam.
2. The only contention made by the learned counsel for the petitioner is that the petitioner is a pardanashin lady and that there is no transport facility from Nagapattinam to Panruti and without the help of any male member, she cannot travel to Panruti. 3.
The above reasons are ordinarily enough for transferring the suit. Admittedly, the cause of action partly arises within the jurisdiction of Nagapattinam. If train facility is not available, definitely, through road the petitioner can very well travel.
4. I do not find any valid reason to transfer the O.S. unnumbered of 2015 on the file of Sub Court, Panruti to Sub Court, Nagapattinam. In view of the above said circumstances, this Transfer Civil Miscellaneous Petition is dismissed. No costs. Consequently, connected Miscellaneous Petition is closed.
