ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 4(1)(C) and 4(1-A)(ii) of TN Prohibition (Amendment) Act in Crime No.40 of 2025, on the file of the respondent Police, seeks anticipatory bail. Page No.1 of 4

2. The case of the prosecution is that the petitioner was found in illegal possession of 100 litres wash and 2 litres of ID arrack. Hence, the case.

3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submits that custodial interrogation of the petitioner is not required and sought for anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that three previous cases are pending against the petitioner and vehemently opposed for grant of anticipatory bail to the petitioner.

5.Considering the above fact and circumstances of the case and since three previous cases are pending against the petitioner, custodial interrogation of the petitioner is required and this Court is not inclined to grant anticipatory bail to the petitioner.
