PRAYER:

Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the first respondent to publish the petitioner's first semester exam results for the ME (Electronics and Communication Engineering) Nov/Dec Examination, 2019 (R-2017) and permit her to write the remaining semester exams in respect of the aforesaid courses.

O R D E R

The Writ Petition has been filed seeking direction to the first respondent to publish the petitioner's first semester exam results for the ME (Electronics and Communication Engineering) Nov/Dec Examination, 2019 (R-2017) and permit her to write the remaining semester exams in respect of the aforesaid courses. 2.The facts of the case are as follows:

The petitioner, after completion of her B.E. Course, joined M.E., Electronics and Communication Engineering in the respondent college for the academic year 2019-2020. She has paid requisite exam fees and she also issued with the hall ticket for the first semester exams during December 2019. Accordingly, she has written the exams and however, the said examination result were not published by the first respondent and the same was withheld.

3. The further case of the petitioner is that in respect of the other semester, she has not been permitted to write the examinations. On enquiry, the third respondent informed that certain issues exists with regard to the affiliation of certain courses and on account of the same, her first semester results were withheld and she was not permitted to write the other semester exams. Therefore, the petitioner made a representation to the respondents. No action was taken so far and hence, the petitioner has filed the present writ petition before this Court seeking appropriate remedy.

4. The learned counsel for the petitioner submitted that the documents furnished with regard to the M.E. (Electronics and Communication Engineering) course does not reflect any controversy. The learned counsel further submitted that the course was within the sanctioned intake and her admission to the said college was also approved by the second respondent vide letter dated 31.01.2020. In the said letter, the second respondent has requested the first respondent to permit the students to appear for the University Examinations as per the approved list enclosed. In such circumstances, there exists no legal impediment for declaring her results and permitting her to write exams in respect of the remaining semesters. This Court may direct the respondent to consider the petitioner's representation and pass appropriate orders within the reasonable time as fixed by this Court.

5.On the other hand, the learned Standing Counsel appearing for the respondents submitted that the representation will be considered and orders will be passed on merits and in accordance with law within the stipulated time as fixed by this Court.

6. Heard the learned counsel for the petitioner and the learned Standing Counsel appearing on behalf of the respondents and perused the materials available on record.

7.Considering the facts and circumstances of the case and having regard the submissions made by the learned counsel on either side, the petitioner is directed to make a fresh representation along with relevant documents and also a copy of this order within a period of two weeks from the date of receipt of a copy of this order. On receipt of such representation, the respondents shall consider the representation and pass orders on merits and in accordance with law, as expeditiously as possible, preferably within a period of four weeks from the date of receipt of a copy of this order.

8.Accordingly, the writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is also closed.
