ORDER

The case of the petitioners is that though they have been released with gratuity but the same having been released at a belated stage, the respondents are liable to pay the interest and hence, the petitioner has come to this Court seeking for a direction to disburse the interest at the rate of 12% per annum from the dates on which the petitioners are retired from service till date of disbursement.

2. The learned counsel appearing for the petitioners submit that the petitioners though made the aforesaid prayer but now they want to file a representation indicating the similarly situated persons have been released with interest but their case has been ignored and in that event, if such representation is made, the respondent be directed to consider his representation.

3. Mr.L.P.Shanmugasundaram, learned Special Government Pleader appearing for respondents have

no objection to consider the representation of the petitioner in accordance with law.

4. Regard being had to the aforesaid facts and circumstances, this Court dispose of this writ petition at the stage of admission giving such liberty to the petitioner, if so advised to make a representation with regard to payment of interest to the 1st respondent and if such a representation is made for delayed payment of gratuity, the 1st respondent shall take an informed and considered decision on the same addressing the contention of the learned counsel appearing for the petitioner that similarly situated persons have been granted interest for delayed payment within in a period of six weeks from the date of receipt of such representation.
