The petitioner who apprehends arrest for the alleged offences punishable under Sections 376, 506(1) of IPC and Section 67A of Information Technology (Amendment) Act, 2008 in Crime No.26 of 2023, on the file of the respondent Police seeks anticipatory bail. 2.The case of the prosecution is that the petitioner and the defacto complainant met in the year 2020, had love affair from 2021 and the petitioner had physical relationship with the defacto complainant by promising her that he would marry her and he had physical relationship with her several times by pressurizing her. Thereafter, the petitioner married his aunt's daughter on 04.10.2023. Hence, the complaint. 3.The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any such offence as alleged by the prosecution.

He further submitted that the petitioner had love affair with the defacto complainant and subsequently the marriage did not take place due to family dispute.

prayed to grant anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl.Side) appearing for the respondent opposed for granting anticipatory bail to the petitioner by stating that the petitioner in the social media has shown the defacto complainant as a prostitute and even he also shown the defacto complainant's sister as a prostitute. In social media they falsely gave a propaganda abusing the characters of the defacto complainant and hence, he vehemently opposed for granting anticipatory bail to the petitioner. 5.Considering the submissions made by the learned Government Advocate (Crl.Side) for the respondent that the photographs and video were taken when the petitioner and the defacto complainant were in physical intimacy published in social media shows the conduct of the petitioner that he would tamper evidence. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
