The husband is before this Court seeking transfer of H.M.O.P. No. 66 of 2013 filed by the wife for dissolution of marriage between her and the petitioner dated 31.10.2011, from the file of Sub Court, Sathyamangalam, to the file of Family Court, Coimbatore. 2.
Both the parties are present before this Court and they categorically stated that they are not interested in reunion as the marriage had irretrievably broken down and therefore, they seek divorce by consent. A joint memo of compromise dated 29.07.2015 is also filed, signed by the petitioner, respondent, her parents and countersigned by the respective counsel, seeking divorce by mutual consent.

In view of the above development, no useful purpose will be served by keeping H.M.O.P. No. 66 of 2013 on the file of Sub Court, https://hcservices.ecourts.gov.in/hcservices/
Sathyamangalam, pending. Therefore, exercising the power under Article 227 of the Constitution of India, this Court, suo motu, withdraws H.M.O.P. No. 66 of 2013 and based on the submission made by both parties and the joint memo of compromise filed by the parties, grants a decree of divorce, by mutual consent, dissolving the marriage between the petitioner and the respondent which was solemnized on 31.10.2011 in the said H.M.O.P. The parties are not pressing the allegations made against each other. The joint memo of compromise shall form part of the decree. The transfer C.M.P. is disposed of accordingly. No costs.
