Will Of K.N.Kittappa v. K.N.Narasimhan

O.P.No.51 of 2016 R.SUBRAMANIAN.J., The parties have entered into a compromise and a joint memo has been filed, in an by which, the 1st respondent has consented for grant of Letters of Administration with a copy of the Will annexed. The other respondents have not appeared despite service.

2. The petitioner has examined himself as PW1. He has produced the death certificate of the Testator as Ex.P2 and that of the Testator's wife as Ex.P3. The original Will has been marked as Ex.P1. The legal heirship certificate has been marked as Ex.P4. Publications have been effected and no objections have been received.

3. One C.S.Vasudevan, who is one of the attesting witnesses of the Will, has been examined as PW2. He has spoken about the execution of the Will by the Testator and its attestation by himself and one K.Bashyam.

4. In the light of the evidence, I find that the petitioner has proved the Will as required under law and is entitled to Letters of Administration with a copy of the Will annexed.

5. In fine, this Original Petition is allowed granting Letters of http://www.judis.nic.in Administration in respect of the Will dated 29.07.1992 in favour of the petitioner.
