Murugamanickam PRAYER The second Appeal filed under Section 100 of Civil Procedure Code, to set aside the judgment and decree made in A.S.No.96/2010 dated 22, June 2011 on the file of the Principal District Judge, Erode which is in the nature of reversing the judgment in O.S.No.66 of 2007 dated 28, July, 2010 on the file of the Subordinate Judge, Gobichettipalayam.

O R D E R

The prayer sought for in the present appeal is to set aside the judgment and decree made in A.S.No.96/2010 dated 22.06.2011 on the file of the Principal District Judge, Erode which is in the nature of reversing the judgment in O.S.No.66 of 2007 dated 28.07.2010 on the file of the Subordinate Judge, Gobichettipalayam.

2. Today, when the matter is taken up for consideration, the learned counsel for the appellants seeks permission of this Court to withdraw the present second appeal . He has also made an endorsement to that effect.

3. Recording the submissions made by the learned counsel for the appellants, the present second appeal is dismissed as withdrawn.
