O R D E R

A4, aggrieved by the issuance of NBW by the impugned order dated 02.04.2016 of the learned VII Additional Sessions Judge, City Civil Court, Chennai in S.C.No.19 of 2014 has directed this revision.

2. A4 seems to be under a misconception that as the case has been stayed by the High Court, he need not attend the court. However, he did not obtain any order dispensing with his personal appearance. In the circumstances, irked by his absence, the trial court has issued NBW against him.

3. Heard both sides. Let us not make any deep research in to the matter.

4. In the circumstances, ordered as under:

(i) The impugned order dated 02.04.2016 passed in S.C.No.19 of 2014 by the learned VII Additional Sessions Judge, City Civil Court, Chennai, insofar as A4 is concerned, is set aside.

(ii) On his filing recall petition, either by appearing in person or through a learned counsel, the learned VII Additional Sessions Judge, City Civil Court, Chennai will recall the NBW.
