(Order of the Court was made by S. NAGAMUTHU,J.,) The petitioner has filed the present writ petition to issue a Writ of Certiorari to call for the records relating to the FIR in Cr.No.939 of 2003 dated 12.11.2003 on the file of the fourth respondent and quash the same.

The petitioner is one of the accused in Cr.No.939 of 2003 on the file of Central Crime Branch, Chennai for the offences punishable under Secs.384 and 506 (ii) IPC. Seeking to quash the First Information Report, the petitioner has come up with this writ petition.

We have heard Mr.V. Selvaraj, learned counsel for the petitioner and Mr.A.N. Thambidurai, learned Special Government Pleader for the respondents 1 to 4 and perused the records carefully.

It is submitted by the learned Special Government Pleader that in the instant case, on completing the investigation, further action was dropped and the said report was also accepted by the learned Magistrate.

Thus, nothing survives in this writ petition. Therefore, the writ petition is dismissed as infructuous. No costs.
