( Criminal Jurisdiction ) Friday, the Seventeenth day of June Two Thousand Twenty Two PRESENT The Hon`ble Dr Justice G. JAYACHANDRAN CRIMINAL ORIGINAL PETITION No.13865 of 2022 1 RAJA [ PETITIONERS / ACCUSED ] 2 VALLI Vs STATE REP BY [ RESPONDENT ] THE INSPECTOR OF POLICE, ULUNDURPET POLICE STATION, KALLAKURICHI DISTRICT.

CRIME NO.97 OF 2022.

For Petitioners : M/S.KRISHNASAMY CHINNASAMY Advocate For Respondent : MR.S.UDAYA KUMAR, Govt. Advocate (Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Section 174(3) altered into Section 306 of I.P.C., in Crime No.97 of 2022, on the file of the respondent Police, seek anticipatory bail.

2. The petitioners are the father-in-law and mother-in-law of the deceased Kanimozhi. This is the fourth anticipatory bail application. Earlier anticipatory bail application was dismissed by this Court on 20.05.2022 in Crl.O.P.No.11903 of 2022. This Court found that the deceased Kanimozhi committed suicide within six years from the date of her marriage due to the cruelty caused by these petitioners while her husband was living abroad.

3. Learned counsel for the petitioners submitted that the prime accused/husband of the deceased was already arrested and released on bail and that being the change in circumstances, the same may be considered for grant of anticipatory bail.

4. Learned Government Advocate (Crl. Side) submitted that investigation is pending due to absconding of these petitioners. Hence, he opposed for grant of anticipatory bail to the petitioners.

5. Considering the materials collected by the investigating agency so far, the judicial custody of the petitioners is required for completion of investigation, this Court is not inclined to grant anticipatory bail to these petitioners. Hence, this Criminal Original petition is dismissed.
