Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents to consider the petitioner's representation dated 20.04.2022. For Petitioner :

ORDER

This Writ Petition has been filed seeking for issuance of a writ of Mandamus to direct the respondents to consider the petitioner's representation dated 20.04.2022.

The case of the petitioner is that he is the owner of the property in Government Punjai Survey No.375/1A, comprised New Survey No.179/2, siutated at Maligaimedu Village, Panrutti Taluk, of an extent of 80 cents of land, which was inherited from his grandfather and registered through settlement deed, dated 28.05.1998, vide Reg.Doc.No.680/1998, on the file of Sub Registrar Office, Panrutti. Further, the petitioner had executed sale deed in favour of one Mr.Manohar, to an extent of 50 cents, vide Reg.Doc.No.505/2020, dated 27.02.2020, on the file of Sub Registrar Office, Panrutti. Subsequent to the execution of the sale deed, the petitioner is in the possession of remaining 35 cents of land. Thereafter, the petitioner had purchased property from one R.Mahalakshmi @ Pavithra, situated at Maligaimedu Village, Panrutti Taluk in New Survey No.179/2 by subdivision in Survey No.179/2B, Old Government Punjai Survey https://hcservices.ecourts.gov.in/hcservices/

No.364, to an extent of 50 cents, by way of sale deed, dated 27.02.2020, vide Reg.Doc.No.504/2020, on the file of Sub Registrar Office, Panrutti. While so, the petitioner made a representation dated 20.04.2022 before the respondents, seeking to survey, measure and fix boundary stones for the aforesaid properties, and the petitioner is ready to pay the necessary charges. As the said representation made by the petitioner has evoked no response from the respondents, the petitioner has filed the present Writ Petition.

Though very many grounds have been raised in this Writ Petition, learned counsel for the petitioner submitted that, it would suffice, if this Court issues direction to the respondents to consider the petitioner's representation dated 20.04.2022 and pass orders on merits within a particular time frame that may be fixed by this Court.

4. The learned Special Government Pleader appearing for the respondents has no objection for the said order being passed.

5. In view of the aforesaid submissions, this Court, without expressing any opinion on the merits of the case, directs the first respondent to consider the petitioner's representation dated 20.04.2022 and pass appropriate orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.

6. With the above directions, this Writ Petition is disposed of. No costs.
