Respondents Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the respondents to forbear from in any manner acting upon pending disposal of the revision filed by the petitioner under Section 10(a)1C of the Tamil Nadu Land Encroachment Act 1905 pending on the file of the 1st Respondent. The order in appeal passed by the 3rd respondent in Na.Ka.No. 3209/ 2022/ Tha3 dated 10.05.2022 confirming the eviction notice issued under section 7 of the Tamil Nadu Land Encroachment Act 1905 on the file of 3rd respondent.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) The writ petition has been filed for interim order pending revision petition under Section 10(a)(1)C of the Tamil Nadu Land Encroachment Act, 1905.

2. There is a provision for interim order by the competent authorities while hearing the appeal or revision and therefore the present writ petition will not be maintainable. However, the writ petition is disposed of with a direction to the revisional authority to hear and consider the stay application or finally decide the revision petition itself within the time frame.

3. The writ petition is disposed of accordingly. No costs. Consequently, connected miscellaneous petition in W.M.P.No.14404 of 2022 is closed.
