O R D E R

(Order of the Court was made by Dr.Anita Sumanth J.) The present Miscellaneous Petition seeks relaxation of the conditions imposed by this Court on 19.11.2025. The conditions imposed are as follows: (i) The petitioner shall execute a bond for a sum of Rs.25,000/-, with two sureties, each for a like sum to the satisfaction of the Sessions Court, Mahila Court/Additional Special Court for Exclusive Trial of Cases under POCSO Act, Coimbatore;

(ii) The sureties shall affix their photographs and Left Thumb Impression in the surety bond and the trial Court may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;

(iii) The petitioner shall appear before the respondent/police on every Monday at 10.30 a.m. until the disposal of the appeal and if he is not able to appear before the trial Court on any day, he shall make arrangements to file an application under Section 317 Cr.P.C. and shall appear before the trial Court on any other day in lieu of the date of his absence, as directed by the trial Court; and (iv) On breach of any of the aforesaid conditions, the learned Sessions Judge is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Sessions Judge himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]

2. Mr.S.Raja Kumar, learned Additional Public Prosecutor, who appears for the respondents, on instructions, would confirm that the petitioner is diligent in abiding by the conditions that have been imposed.

3. On the suggestion of the Court that the conditions at S.No.(iii) above may be modified to read that the petitioner will appear before the respondent police on the first Monday of every month, he has no objection. Hence, condition in S.No.(iii) imposed on 19.11.2025 is modified to read as follows: (iii) The petitioner shall appear before the respondent/police on the first Monday of every month at 10.30 a.m. until the disposal of the appeal and if he is not able to appear before the trial Court on any day, he shall make arrangements to file an application under Section 317 Cr.P.C. and shall appear before the trial Court on any other day in lieu of the date of his absence, as directed by the trial Court.
