No.412 Health and Family Welfare (MCA-1) Department dated 15.03.2018 issued by the 1st respondent and to quash the

same in so far as non-inclusion of service personnel in Military/Para Military Forces as service candidates for selection and admission to M.D.S. courses is concerned and consequently directing the respondents to consider the petitioner as Service Candidate for admission to MDS course under State quota seats in the State of Tamil Nadu and further to award incentive marks for the services rendered by the petitioner in Assam Rifles in high counter insurgency areas of North Eastern States, as per Regulation 7(2) of 'Dental Council of India, Master of Dental Surgery Course Regulations, 2017' for admission to MDS course in 2018-19 Session.

The relief sought for in this writ petition is to call for the records relating to Clause 8(a) of Prospectus for Admission to MDS courses dated 16.03.2018 issued by the 3rd respondent, as approved in G.O(D). No.412 Health and Family Welfare (MCA-1) Department dated 15.03.2018 issued by the 1st respondent and to quash the same in so far as non-inclusion of service personnel in Military/Para Military Forces as service candidates for selection and admission to M.D.S. courses is concerned and consequently directing the respondents to consider the petitioner as Service Candidate for admission to MDS course under State quota seats in the State of Tamil Nadu and further to award incentive marks for the services rendered by the petitioner in Assam Rifles in high counter insurgency areas of North Eastern States, as per

Regulation 7(2) of 'Dental Council of India, Master of Dental Surgery Course Regulations, 2017' for admission to MDS course in 2018-19 Session.

2. Though the writ has been filed for Certiorarified Mandamus, the learned counsel appearing for the petitioner states that the representation given in March 2018 must be considered and disposed of by the first respondent particularly.

3.Heard the learned counsel for the respondents, who took notice. It would be appreciable if the first respondent applies his mind and disposes the representation on or before 23.05.2018. The petitioner is also permitted to send an additional copy of the representation along with the copy of this order to the first respondent and also to any other authority who are deemed necessary.
