R.SUBBIAH, J and T.KRISHNAVALLI, J (The Order of the Court was made by R.Subbiah, J) This petition has been filed to set aside the Award passed by the second respondent against the petitioners on 20.04.2016 in A.R.C.No.38 of 2016.
2. The first respondent herein is a tenant under the first petitioner. The tenancy was for a period of 4 years and 6 months from 02.04.2013 to 24.10.2017. For the purpose of tenancy, rental agreement was entered into between both of them. As dispute arose between both of them with respect to tenancy, the second respondent was appointed as an Arbitrator. On 20.04.2016, the Arbitrator has passed the Award. Aggrieved by the same, the present Original Petition has been filed by the landlord under Section 34 of the Arbitration and Conciliation Act, 1996 to set aside the Award passed by the Arbitrator.
3. While so, the petitioners filed R.C.O.P.No.72 of 2016 before the Principal District Munsif Court, Poonamallee for eviction. In the meantime, there was a compromise between the petitioners and the first respondent, pursuant to which, the first respondent vacated the premises in question and handed over the vacant possession of the premises. Therefore, the issue between the parties 1/3
had been resolved.
4. Today, when the matter is taken up for consideration, the parties have filed joint memo of compromise, dated 10.09.2019, which had been signed by the parties and their respective counsel. The parties have also appeared before us along with their respective counsel. We have also enquired the parties who submitted that there was amicable settlement between them and prayed that the O.P. may be disposed of.
5. Recording the said compromise between the parties, this petition is disposed of. The joint memo of compromise shall form part of the order. (R.P.S.J) (T.K.J) 12.09.2019 cs 2/3
