ORDER
The petitioner was convicted by order dated 01.02.2025 in S.T.C.No.5826 of 2023 on the file of the Metropolitan Magistrate, FTC-II, Egmore @ Allikulam, Chennai for the offence under section 138 of the Negotiable Instruments Act, 1881 and was sentenced to undergo one year simple imprisonment and to pay a cheque amount of Rs.20,00,000/- within 30 days 1/4
from the date of the judgment and in default to undergo 2 months simple imprisonment.
2.It is the contention of the learned counsel for the petitioner that aggrieved against the said judgment, the petitioner filed an appeal in C.A.No.1010 of 2025 and also filed a petition seeking for suspension of sentence in Crl.M.P.No.8857 of 2025. The appeal was admitted and the suspension of sentence was granted by the Sessions Court on 16.09.2025 directing the petitioner to deposit 20% of the compensation amount to the credit of STC No.5826 of 2023 within 60 days. Thereafter, the petitioner filed a petition in Crl.M.P.No.3 of 2025 seeking for modification and permission to deposit 5% of the cheque amount. The said petition was dismissed, against which the petitioner preferred Crl.OP.No.4019 of 2026. This court by order dated 18.02.2026 disposed of the original petition and directed the petitioner to deposit 10% of the compensation amount before the trial court within a period of four weeks.
3.It is further submitted that following the order of this court, the petitioner had taken a demand draft of Rs.2,00,000/- on 26.03.2026 and presented it before the trial court in S.T.C.No. No.5826 of 2023. The trial court received the same on 27.03.2026 and when the same was sent to the Chief Metropolitan Magistrate Court, the same was returned stating that there was one day delay in complying with the order of the High Court. Therefore, the 2/4
learned counsel prayed for granting extension of time. 4.Considering the submissions made and in the light of the facts and circumstances of the case, the delay is condoned. The petitioner is directed to resubmit the demand draft before the trial court within a period of ten days from the date of receipt of copy of this order. The trial court is directed to accept the same. With the above directions, this criminal miscellaneous petition is ordered. No costs.
