This Civil Revision Petition has been preferred seeking for a direction for early disposal of the DVC No.4 of 2021 pending on the file of the learned Judicial Magistrate, Rasipuram, Namakkal District.

2. Learned counsel for the petitioner submitted that the 1st petitioner is the wife of the 1st respondent and the 2nd petitioner is their daughter. The revision petitioners have filed an application under Protection of Women from Domestic Violence Act, 2005 and sought certain orders; despite there is fixed time limit to dispose this application, the proceedings are pending for a long time and hence, a direction should be given to the learned Judicial Magistrate, Rasipuram to dispose the matter early.

3. It is seen from the DVC application filed by the 1st revision petitioner that she had sought residential order, maintenance and also protection order. Despite the petition was filed in the year 2021, no order has been passed till now. The Court diary would show that the case is adjourned for several hearing for filing counter. Since, the petitioner filed a petition to seek urgent orders under the Protection of Women from Domestic Violence Act, 2005, the learned Judicial Magistrate, Rasipuram has to consider the same with all seriousness and pass orders as early as possible.

4. Since, the petitioner has alleged various kinds of abuse and she is living alone with her child without any economic support, the learned Judicial Magistrate, Rasipuram ought to have passed orders atleast for maintenance and residence. Since, the relief sought for requires the urgent intervention of the Court, it is appropriate to impress the learned Judicial Magistrate, Rasipuram to bestow his best attention for disposing the matter as expeditiously as possible.

5. In the result, the Civil Revision Petition is disposed of and the learned Judicial Magistrate, Rasipuram is directed to dispose the proceedings in DVC.No.4 of 2021 as expeditiously as possible, preferably within a month from the date of receipt of a copy of this order. No costs.
