(Order of the Court was made by R.SUBRAMANIAN, J.) Mr.P.V.Sanjeev, learned counsel appears for the respondent.

2.Though the CMA was numbered overlooking the fact that there was a delay in filing the appeal on the terms that the limitation for filing an appeal is 90 days and not 30 days, the said defect has been cured by filing an application for condonation of delay.

3.Being satisfied with the reasons assigned in the affidavit filed for the delay, this Civil Miscellaneous Petition is allowed and the delay in filing the appeal is condoned.
