O R D E R
The instant writ petition has been filed, to return of original certificate as well as the refund of the 2nd year academic fees.

Though the prayer of mandamus sought for in respect of the above two reliefs, when the writ petition is taken up for disposal, the learned counsel for the petitioner submitted that he is not pressing the prayer in respect of the refund of fee and he is only interested in return of original academic certificate.

At this juncture, the learned counsel appearing for the 2nd respondent would submit that they will return the original academic certificate within a period of two weeks from the date of receipt of a copy of this order. However, he would seek liberty of this Court to proceed against the petitioner in accordance with the UGC guidelines as well as Prospectus clauses to recover the damages and other eligible amount from the petitioner.

4. In view of the above submissions, this Court directs the 2nd respondent to return the original certificate within a period of two weeks from the date of receipt of a copy of this order. However, the 2nd respondent is at liberty to proceed against the petitioner in accordance with UGC guidelines as well as Prospectus clauses, so as to recover the damages and penalty. As against the prayer for refund of Rs.4,10,000/-, the present writ petition is dismissed.
5. In the result, this writ petition is partly allowed as indicated above.
